EMERGENCY OCCUPANCY AND USE RESTRICTIONS

NATIONAL FOREST AREAS AND NATIONAL FOREST SYSTEM TRAILS AND ROADS

DESCHUTES NATIONAL FOREST

SISTERS RANGER DISTRICT

Pursuant to 16 USC, 36 CFR 261.50(a) and (b) the following acts are prohibited on areas and designated sections of National Forest system trails and roads as described below, and as shown on the attached map, within the Deschutes National Forest, hereby incorporated into this order as Attachment 'A'.

Beginning at a point located at the intersection of Highway 242 and the northwest corner of Township 15 South, Range 10 East, Section 8; thence west along Highway 242 to its intersection with the Pacific Crest Trail located in Township 15 South, Range 08 East, Section 17; thence south along the Pacific Crest Trail to its intersection with the Deschutes/Lane County line in Township 15 South, Range 08 East, Section 20; thence south along the Deschutes/Lane County line to its intersection with the Pacific Crest Trail in Township 15 South, Range 08 East, Section 4; thence south along the Pacific Crest Trail to its intersection with Trail # 3531 in Township 16 South, Range 08 East, Section 8; thence east through sections 8 and 9, to its intersection with the Deschutes/Lane County line in Township 16 South, Range 08 East, Section 9; thence south along the Deschutes/Lane County line to its intersection with the south line of Township 17 South, Range 08 East, Section 09; thence east along the south line of Township 17 South, Range 08 East, Sections 09, 10, 11, and 12; continuing east along the south line of Township 17 South, Range 09 East, Sections 07 and 08; thence south along the west line of Township 17 South, Range 09 East, Section 16; thence east along the south line of Township 17 South, Range 09 East, Sections 16, 15, 14, and 13; thence north along the east line of Township 17 South, Range 09 East, Sections 13, 12, and 01; continuing north along the east line of Township 16 South, Range 09 East, Sections 36 and 25; thence east along the south line of Township 16 South, Range 10 East, Sections 19 and 20; thence north along the east line of Township 16 South, Range 10 East, Sections 20, 17, 08, and 05; thence east along the south line of Township 15 South, Range 10 East, Section 33; thence north along the east line of Township 15 South, Range 10 East, Section 33, 28, 21, and 16 to its intersection with Forest Road 4606; thence northwest along Forest Road 4606 to its intersection with Forest Road 1605; thence northwest along Forest Road 1605 to the corner of Township 15 South, Range10 East, Section 8; thence north along the west line of Township 15 South, Range 10 East, Section 8; back to the point of beginning.

Forest Road 370 from its intersection with Forest Road 4601 in Township 17 South, Range 09 East, Section 36; thence north along Forest Road 370 to its intersection with the south line of Township 17 South, Range 09 East, Section 13.

PROHIBITIONS

It is prohibited to go into or be upon any of the above described lands which are closed for the protection of public health and safety, including all National Forest System roads and trails therein. 36 CFR § 261.53(e)

These restrictions are in addition to those prohibitions enumerated in Subpart A of 36CFR§261 and any other special restrictions pertaining to the described lands.

EXEMPTIONS

Pursuant to 36 CFR§261.50(e), the following persons are exempt from this order:

1. Personnel with written authorization by a Forest Officer, which specifically authorizes the otherwise prohibited act or omission. The issuing Officer may include such conditions as are considered necessary for the protection of the area, or for the promotion of the health, safety, or welfare of its users.

2. Any Federal, State, or local Officer or volunteer in the performance of an official duty.

3. Persons or their invitees who live or own property within the closure area, and permittees who have a legitimate need to access their permitted allotment, escorted or approved by IMT.

4. Forest Roads 4606 and 1605 along the boundary line shall remain open.

This closure is enacted due to firefighting activities taking place within the closure area, and for the protection of public and employee safety. This order replaces Order # 06-01-05-12-001, which is hereby rescinded. These prohibitions will remain in effect until rescinded.

VIOLATION OF THESE PROHIBITIONS IS PUNISHABLE AS A CLASS B MISDEMEANOR, BY A FINE OF NOT MORE THAN $5,000 FOR AN INDIVIDUAL OR $10,000 FOR A LEGAL ENTITY OTHER THAN AN INDIVIDUAL, OR IMPRISONMENT FOR NOT MORE THAN SIX (6) MONTHS, OR BOTH. TITLE 16 USC, SECTION 551; TITLE 18 USC, SECTION 3551.
