NATIONAL FOREST SYSTEM SPECIAL CLOSURE

NEZ PERCE-CLEARWATER NATIONAL FORESTS

FOREST SUPERVISOR'S ORDER

Pursuant to 36 CFR 261.50(a), the following acts are prohibited on designated portions of National Forest System Lands on the Powell Ranger District in the Nez Perce-Clearwater National Forests. These restrictions are in addition to those enumerated in Subpart A, Part 261, Title 36, Code of Federal Regulations (CFR) and become effective upon signature and remains in effect until rescinded.

It is prohibited to go into or be upon any area which is closed for the protection of:

1. public health or safety. 36 CFR 261.53(e)

Described East Boundary Area:

The Area within the described boundary beginning at the Idaho-Montana Boundary and the Selway Bitterroot Wilderness (SBW) boundary in Sec. 32, T38N, R17E, Boise Meridian(BM), thence southwesterly along the SBW boundary to the east ¼ section corner of section 6, T37NR17E, BM, thence westerly to the west ¼ section corner of sec. 2, T37NR16E, BM, thence southerly to the southwest section corner of section 2, T37NR16E, BM, thence westerly along the section line to Trail 940, thence southerly along Trail 940 to Road 369 at Beaver Ridge Lookout, thence westerly along and including the Road 369 to the junction with Road 368 , thence southwesterly along the downhill edge of Road 368 to the approximate N1/16th section corner on the west section line of section 30, T37NR15E, BM, thence southerly to the southwest section corner of section 30, T37NR15E, BM, thence westerly to the southwest section corner of section 25, T37NR14E,BM, thence southerly to the southeast section corner of 35, T37NR14E, BM, thence southwesterly to the SW corner of Sec 1, T36NR14E, BM, thence southerly to the southeast section corner of section 11, T36NR14E, BM, thence westerly to the southwest corner of section 11, T36NR14E, BM, thence south along the section lines to the southwest section corner of section 2, T35NR14E, BM, thence westerly along the section lines to the southwest section corner of section 4, T35NR14E, BM, thence south along the section lines to the southwest section corner of section 4, T34NR14E, BM, thence westerly along the section lines to the Nez Perce and Clearwater National Forests boundary, thence southerly and easterly along Nez Perce and Clearwater National Forests boundary to the Idaho-Montana boundary at Blodgett Mountain, thence northerly along the Idaho-Montana boundary to the point of beginning.

Described West Boundary Area:

The Area within the described boundary beginning at Trail 469 at Mocus Point Pack Bridge, thence southerly along the Trail 469 to the junction of Trail 208, thence southerly along Trail 208 to the junction of Sponge Creek and Fish Lake Creek, thence southerly along Fish Lake Creek to junction of California Creek and Trail 211, thence southeasterly along Trail 211 to the junction of Trail 644 at the Nez Perce and Clearwater National Forests boundary, thence easterly along Nez Perce and Clearwater National Forests boundary to Army Mule Saddle, thence easterly along Trail 60 to the junction with Trail 89 thence northerly on Trail 89 to the headwaters of Saturday Creek, thence northerly along Saturday Creek to Trail 24, thence easterly along Trail 24 to the southeast section corner of section 36, T36NR13E, BM, thence northerly following section lines to the northeast corner of section 1, T36NR13E, BM, thence westerly to approximate ¼ section corner of section 1, T36NR13E, BM, thence northerly following section lines to the south bank of the Lochsa River, thence westerly along the south bank of the Lochsa River to the point of beginning.

Pursuant to 36 CFR 261.50 (e), the following are exempt from this order:

·1. Persons with a permit specifically authorizing the otherwise prohibited use.

·2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

·3. Forest Service administrative traffic.

·4. Trails 469 and Trail 208 as described in the West Boundary Area are open to use.

RATIONALE: These restrictions are promulgated to provide for public safety during periods of active fire in the Powell Complex area.

PENALTY: Violation of this order is prohibited by provisions of the regulations cited, and under USC 551 and 18 USC 3559 and 3571. Any violation is subject to punishment by a fine of not more than $5000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both.

NOTIFICATION: A copy of this order shall be posted in the Forest Supervisor's Office and each District Ranger's office and other appropriate locations as prescribed under Title 36 CFR 261.51.
