Fire Emergency Area Closure

Order No. 04-07

Pursuant to 36 CFR 261.50(a) and to protect public safety, the following acts are prohibited within Antelope Complex Fires Closure Area of the Plumas National Forest. This order is effective from July 7, 2007, until the Antelope Complex Fires have been suppressed.

  1. Going into or being upon National Forest System lands including within the Antelope Complex Fires Closure Area. This are is bounded by Forest Roads 29N43, to the forest boundary, east to County Road 208, State Highway 395, County Road 336, 26N16, 26N06, 28N01, 26N08, 26N65, County Road 336, 28N19, 28N02, to 29N43 as show on Exhibit A. 36 CFR 261.52(e).
  1. Being on any National Forest System road within the Antelope Complex Fires Closure Area. 36 CFR 261.54(e).
  1. Being on National Forest System trail within the Antelope Complex Fires Closure Area. 36 CFR 261.55(a).

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order:

  1. Persons with a permit from the Forest Service specifically authorizing the otherwise prohibited act or omission.
  1. Owners or lessees of land in the closure are to the extent necessary to gain access to their land.
  1. Residents in the closure area to the extent necessary to gain access to their residences.
  1. Any Federal, State, or local officer or member of an organized rescue or fire fighting force in the performance of an official duty.

These prohibitions are in addition to the general prohibitions found in 36 CFR Part 261.

A violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC 551 and 18 USC 3559, 3571, and 3581.

Antelope Complex Closure Order

Decision

It is my decision to implement the Antelope Complex Closure (order No. 04-07). This order will protect public safety by closing an area to public use where public safety could be jeopardized by both on-going fire suppression operations and fire weakened hazard trees. Landowners and leasers with land inside the closure area would be specifically exempted as would those members of the public with contracts requiring work inside the area.

Reasons for Categorically Excluding the Proposed Action

This order is covered under the provisions of FSH 1909.15.31.12 category 1, "Orders issued pursuant to 36 CFR Part 261- Prohibitions to provide short-term resource protection or to protect public health and safety." No extraordinary circumstances exist in relation to this Forest Order and therefore do not warrant further analysis and documentation. The environmental impact of the proposed action is negligible. There is no ground disturbance nor any fish and wildlife habitat modification associated with these closure orders. Nest sites for bald eagles do exist in the vicinity of the closure, and would not be impacted in any way due to this closure. No flood plains, wetlands, or municipal watersheds will be affected by this decision. There are no American Indians and Alaska Native religious nor cultural sites nor are there any archaeological sites, or historic properties or areas impacted by my decision.
